At HEAL Planning, we specialise in taking planning challenges and turning them into planning successes. In this case study, Managing Director John Peters explains how our team secured approval for a complex householder planning application in Maidenhead, within the Royal Borough of Windsor and Maidenhead, after it was initially refused.
The original proposal involved significant extensions and alterations to a private dwelling, including:
Single storey front and side extensions
A two storey rear and side extension
Alterations to the property’s fenestration
Demolition of the existing conservatory and garage
Despite being a well-designed scheme, the application was refused at the first attempt. The refusal hinged on one critical issue – the absence of ecological information, specifically a bat survey. Under both national and local planning policy, protected species such as bats must be considered before development can proceed. Without the required survey, the local planning authority had no option but to refuse.
Rather than appealing, which would have meant unnecessary delay, our client approached us for advice. After a free, no-obligation consultation with one of our planning application assessment officers, we concluded that a carefully structured resubmission would be the best route to achieving approval. This would save time, reduce uncertainty, and provide the local authority with the evidence it needed.
We set out a clear written proposal for our client, including the steps, costs, and strategy. Once instructed, HEAL Planning coordinated a professional bat survey through a qualified ecological consultancy. The survey confirmed that no bats were roosting or emerging from the dwelling. Crucially, this demonstrated that the development would not cause harm to protected species and that no European Protected Species licence was required.
With this key evidence in place, we prepared a revised planning application supported by a robust planning statement. Our submission addressed all relevant planning considerations, including:
Protection of ecological assets
Character and appearance of the local area
Neighbouring residential amenity
On-site parking provision
Trees and landscaping impacts
On the 4th of June, the Royal Borough of Windsor and Maidenhead approved the revised application. The case officer confirmed that, with the ecological information provided, the proposal fully complied with local plan policies. A small number of standard conditions were attached, including material samples and adherence to the bat survey findings, but the crucial outcome was that permission was granted.
This planning success illustrates how strategic resubmission, supported by expert evidence, can overcome previous refusals without the need for an appeal. At HEAL Planning, we combine deep knowledge of local and national policy with a practical, client-focused approach. By identifying the most effective route forward, we help homeowners, developers, and landowners secure the planning approvals they need.
